1 · Agreement

These Terms & Conditions (“Terms”) are an agreement between you and Blackbird R&D (“Blackbird,” “we,” “us”). By accessing this website or placing an order, you accept these Terms. If you do not agree, do not use the site.

2 · Eligibility

This site and our products are intended for individuals who are at least 21 years of age and legally permitted to purchase and possess the products offered, under all applicable federal, state, and local laws. By using the site you represent that you meet these requirements. We may refuse or cancel any order where eligibility is in question.

3 · NFA items · how a suppressor purchase works

Suppressors are regulated by the National Firearms Act (NFA). Placing an order on this site initiates a purchase; it does not transfer possession. Every suppressor transfer is completed through a federally licensed dealer (FFL/SOT), either our fulfillment partner or a licensed dealer you designate, and requires ATF approval, including a Form 4 application and the federal transfer tax. You take possession only after the ATF approves your application and the transferring dealer completes the transfer under its own procedures.

ATF approval timelines are outside our control, and approval is not guaranteed. It is your responsibility to confirm that suppressor ownership is lawful where you live before ordering. Suppressors are not available in every state, and we may cancel orders shipped to or placed from jurisdictions where they cannot be lawfully transferred.

4 · Orders, cancellations & returns

All orders are subject to acceptance and availability. Once an NFA transfer process has begun, an NFA item cannot be returned or exchanged; if an ATF application is denied, contact us and we will work with you and the transferring dealer on the available remedy, which will be confirmed in writing. For non-NFA items (adapters, muzzle devices, apparel), contact us for a return authorization before sending anything back; items must be unused and in original packaging.

5 · Pricing & product information

Prices, specifications, and availability may change without notice. Published specifications describe the product as manufactured; minor variations occur. We work to keep the site accurate, but we may correct errors, including pricing errors, and may cancel and refund any order placed in reliance on an error.

6 · Accounts

You are responsible for the accuracy of the information in your account, for keeping your credentials confidential, and for activity that occurs under your account. We may suspend accounts used in violation of these Terms.

7 · Intellectual property

This site and its content, including text, renders, figures, graphics, and software, belong to Blackbird or its licensors. BLACKBIRD, DECOUPLR, PLENUM, and Staged Pressure Vectoring™ are trademarks of Blackbird; Staged Pressure Vectoring™ technology is patent pending. No content on this site grants you any license to our intellectual property. Do not scrape, reproduce, or reverse-engineer site content or product geometry.

8 · Acceptable use

Do not use this site to violate any law, to attempt unauthorized access to our systems, to interfere with the site’s operation, or to submit false, misleading, or automated content through our forms.

9 · Export control

Our products and technical data are subject to U.S. export control laws. Products purchased through this site are for domestic delivery only and may not be exported, re-exported, or transferred outside the United States without required U.S. government authorization.

10 · Safety, disclaimers & limitation of liability

Firearms and firearm accessories are inherently dangerous. Install and use products only as described in the accompanying documentation, on compatible host systems, with proper training. Except as required by law and any written warranty that accompanies a product, the site and products are provided “as is,” and we disclaim implied warranties to the fullest extent permitted. To the fullest extent permitted by law, Blackbird is not liable for indirect, incidental, or consequential damages arising from the site or the products, and our total liability for any claim is limited to the amount you paid for the product giving rise to the claim.

11 · Indemnification

You agree to indemnify Blackbird against claims arising from your breach of these Terms, your violation of law, or your misuse of the products.

12 · Governing law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Texas.

13 · Changes

We may update these Terms from time to time. The effective date above reflects the current version; continued use of the site after changes take effect constitutes acceptance.
